I reserve the right to refuse or discontinue a commission at any time.

The terms outlined here may vary slightly depending on the type of commission.

The Client hereby commissions the Artist to create the following piece(s) of work.

The Artist agrees to complete and deliver the Commissioned Work to the Client by agreed date.

Payment(s) shall be made as follows: 50% of Amount paid up front, prior to beginning work, and 50% of Amount paid prior to delivery of the finished files to the Client. Payment shall be made in USD via Paypal Invoice sent by Krisandra. Priority will be first come, first serve, in order of payment (excluding rush commissions.)

Write in a clear and concise manner when filling out the commission form.

Maintain professional conduct throughout the commission process.

Respond in a timely fashion.

Assume responsibility for any important information and clear descriptions/references you fail to provide me that results in my inability to complete your commission to your full satisfaction.

Carefully read through the ToS and Commission Information.

Please make a best effort to have your fbx file(s) in a ready state (clipping, rigging, shape-keys, UV tile discard, mesh names, etc.) before I proceed to work.

I am not responsible for any VRChat updates that might break the package in future updates (I do my best to prevent that).

Revisions during the product delivery stage are allowed up to 1 week after the commission is done.

Excessive minor revisions to the point that has halted any forward progress from happening will incur additional fees.

Max revisions before the fees increase dramatically is started at four revisions per stage.

Artist: The Artist retains all rights, title, and ownership of the Commissioned Work, including but not limited to copyright, use of Commissioned Work for promotional purposes (via social media, portfolio, marketing material, etc.), and display of Commissioned Work during live streams or social media posts (work-in-progress streams, status updates, etc.) At the request of Client and while agreed upon by Artist, the Commissioned Work can be done privately for an additional charge (no work-in-progress streams, status updates, etc.)

Client: The Client is granted permission to edit the Commissioned Work after the delivery of finished files. The Client agrees not to make any alterations, modifications, or reproductions of the Commissioned Work that would violate the Terms of Service of any and all platforms the Commissioned Work may be used for. The Artist shall not be held responsible for any errors that may occur from such editing done by the Client.

Personal: The Client is granted an exclusive license to use the Commissioned Work for personal purposes only, unless otherwise agreed upon in writing. The Client may request commercial rights at a later date if agreed upon by the Artist.

Commercial Asset: The Client is granted an exclusive license to use the Commissioned Work for commercial purposes on a completed, for sale model. The Client must credit the Artist in the following format: [Asset name] by Krisandra [Link to commission page].

Commercial Model for Streaming: The Client is granted an exclusive license to use the Commissioned Work for streaming purposes and reproduction rights for streaming content only, unless otherwise agreed upon in writing. The Client must credit the Artist in the following format: [Model name] by Krisandra [Link to commission page].

Alterations: The Client agrees to one to three (1 to 3) revisions during each stage of work (Blender, Substance Painter, Unity, Final Testing) of the commission. The Client agrees not to request changes after six (6) months or more following the delivery date and agreed upon completion of the Commissioned Work.

Warranty: The Artist is responsible for issues that may arise due to a VRChat update for up to three (3) months after the completion of the Commissioned Work. The Artist shall not be held responsible for any errors resulting from incorrect use by the Client.

Cancellation: In the event that the Client wishes to cancel the Commissioned Work before completion, the Client shall forfeit any payments made up to the date of cancellation. The Artist reserves the right to retain the Commissioned Work and to use it in any manner. The Artist reserves the right to cancel if completion of the Commissioned Work is not possible for any reason.

Refusal: The Artist has the right to refuse projects according to personal discernment and capabilities. Some examples of content that the Artist will not be comfortable representing include, but are not limited to:

Fully Mecha/Robotic

Loli/Underage/Chibi

Excessively Violent or Gore

Copying others' style and/or art the Client does not own the rights to

Anything hate related (Racism, Homophobia, etc.)

Fees:

Commercial Rights (Asset): +50% of base price.

Commercial Rights (Streaming): +50% of base price.

Late-Stage major edits: +25% of base price.

Rush Fee: +50% of base price.

Miscellaneous: The Client agrees to be 18 years or older. The Client is not permitted to use the Commissioned Work for AI and/or NFTs. The Client shall not claim my work as their own. The Client is not allowed to resell the Artist’s work.

Indemnification: The Client agrees to indemnify and hold the Artist harmless from and against any and all claims, losses, liabilities, damages, costs, and expenses arising out of or related to the Commissioned Work.

Entire Agreement: This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all prior and contemporaneous agreements and understandings, whether oral or written.

Modification: This Agreement may only be modified or amended in writing and signed by both parties.

Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

Disclaimer: I, Krisandra, am chronically ill, with issues that arise randomly. I reserve the right to delay the commission work as needed due to health concerns, however, I will always return to the Commissioned Work as soon as possible.
